Agreement to the “Terms Of Use”

Please read this agreement carefully before using this site. By using this site, you signify your agreement to this Terms of Use agreement. If you do not agree to the terms and conditions contained in this Terms of Use agreement, you may not access or otherwise use this site.

Privacy Statement:

Will Trilight, Inc., Inc. share my information with other companies?
Trilight, Inc., Inc. does not sell, rent, or lease customer information. We currently do not employ other companies or individuals to perform functions on our behalf, and we have no need to disclose any personally identifiable information in order to process the activities and functions that Trilight, Inc. customers request. Examples include sending postal mail and email that customers have requested, removing repetitive information from customer lists, analyzing data, providing assistance processing credit card payments, and providing customer service. All work is done in house by employees under confidentiality agreements. We only use personal information to perform these type of requested functions, and do not use it for other purposes.

Apart from this, we would only disclose personal information if in the good faith belief that we are required to do so by law, or that doing so is reasonably necessary to:
Comply with legal process;
Respond to any claims; or problems with shipping products to customers;
Protect the rights, property, shipments or personal safety of Trilight, Inc., our customers, or the public.
Trilight, Inc. does not provide information even in statistical form, including web sessions, sales, etc., to third parties. Even trend statistics done in house do not contain any personal or identifying information. We feel we do everything we can do to protect your privacy.

Please note that the personal information you provide us will be used for the purpose of processing, delivery or tracking your order by Trilight, Inc., its affiliates and agents, ie: UPS or USPS. By submitting your order, you consent to this transfer.


How does Trilight, Inc. secure my personal information?
Trilight, Inc. uses reasonable precautions to protect your personal information stored on our system from loss, misuse and unauthorized access, disclosure, alteration and destruction. While no computer system is completely secure, we believe the measures implemented by our site reduce the likelihood of security problems to a level appropriate to the type of data involved.

Trilight, Inc. has built into Trilight, Inc.'s Online Store an order submission process that encrypts any information you send to us. You do not have to do anything to have your information encrypted, it is already there if you are using an encryption enabled browser. Trilight, Inc. uses the widely adopted Secure Sockets Layer (SSL) technology to accomplish this encryption. By encrypting your information, our intent is to make it extremely difficult for someone to be able to use your information even if it is intercepted.

If you don't feel comfortable sending your personal information to us over the Web, please use the Trilight, Inc. sites to browse our product offerings and then give us a call at 530-292-1236 to place your order over the phone. You can also send by mail a check or money order for the amount due. This will delay the shipment of your order.

Information on the Site

We reserve the right to delete, block and remove any information or materials at our sole discretion or if it deems to be unlawful, infringing, defamatory, libelous, abusive, threatening, obscene, offensive, fraudulent, deceptive, inappropriate or otherwise unacceptable.   We try our best to have pricing and information correct on the website.  If we make a mistake we reserve the right to make corrections.  Price, availability and information on this site is subject to change without notice.

User Submissions and Emails:

We have no intentions to post submissions related to our products without your permission.  Any suggestions, ideas, comments or other similar submissions by users shall be deemed the sole property of Trilight, Inc., which shall not be liable for any use or disclosure, including without limitation use for commercial purposes, of such submissions. If we use your comment to share with other customers then you are agreeing to grant us a worldwide, royalty-free, perpetual license, with the right to reproduce, transmit, distribute, publicly display, publicly perform, create derivative works of and sublicense any materials or other information contained in such submissions. You hereby waive any claim, cause of action or other recourse that you might have against us for any alleged or actual infringement or misappropriation of any intellectual property or other right in any such submissions. If there is a submission from you that you would like removed please let us know immediately.

Your Usage of Site; Termination of Usage

You agree to maintain the security of your account on the site, including the security of your password and other confidential information relating to the use of the site and your account on the site. You agree to be responsible for all charges resulting from the use of your account on the site, including charges resulting from unauthorized use of your account prior to your taking steps to prevent such occurrence by changing your password and notifying us.

We are not responsible for shipping to states or countries where any of our products may be illegal

Usage by Minors

Because of the nature of the World Wide Web, we cannot prohibit minors from visiting this site. We must rely on parents, guardians and those responsible for supervising children and teenagers to decide which materials are appropriate for such children and teenagers to view and/or purchase. We requires that (i) all purchases on the site be made by adults 18 years of age or older, and (ii) all users who provide personal information to us be 18 years of age or older, or, if under 18, that such information be accompanied by verifiable parental consent.

Applicable Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of the State of California without regard to choice of law rules. Each user agrees to submit to personal jurisdiction in the State of California and further agrees that any cause of action arising from or relating to the use of this site or this agreement shall be brought exclusively in a court California.

Severability; Interpretation

If any provision of this agreement shall be deemed unlawful, void or for any reason unenforceable by a court of competent jurisdiction, the validity and enforceability of any remaining provisions shall not be affected. When used in this agreement, the term "including" shall be deemed to be followed by the words "without limitation."


Entire Agreement and Amendments

This agreement constitutes the entire and only agreement between Trilight, Inc. and each user of this site with respect to the subject matter of this agreement and supercedes any and all prior or contemporaneous agreements, representations, warranties and understandings, written or oral, with respect to the subject matter of this agreement. You agree to review this agreement prior to your use of this site and your use of this site shall be deemed acceptance of and assent to this agreement by you. Trilight, Inc. may, in its sole discretion, amend this Terms of Use agreement from time to time.


Miscellaneous

The failure of Trilight, Inc. or its affiliates to insist upon strict adherence to any term of this agreement shall not constitute a waiver of such term and shall not be considered a waiver or limit that party's right thereafter to insist upon strict adherence to that term or any other term of this agreement. You agree that regardless of any statute or law to the contrary, any claim of cause of action arising from or relating to use of this site or this agreement must be filed within one (1) year after such claim or cause of action arose, or will be forever barred. The "No Warranty; Disclaimer" and "Limitation of Liability" provisions of this agreement are for the benefit of Trilight, Inc. and its affiliates as defined herein, and each of these individuals or entities shall have the right to assert and enforce these provisions directly against you on its own behalf.

As you visit links to third-party Web sites, you will be subject to such third parties' privacy policies. Trilight, Inc. expressly disclaims any and all liability for the actions of third parties, including without limitation actions relating to the use and/or disclosure of Personal Information by third parties.
